PARTIAL REVISION OF THE SWISS FEDERAL ACT ON PATENTS FOR INVENTIONS
It should be reiterated that the partial revision of the Federal Act of Switzerland on Patents for Inventions (Loi fédérale sur les brevets d’invention – LBI) serves the objective of bringing it into alignment with “international standards” and thereby enhancing the validity of the Swiss national patent. On 15 March 2024, in the context of the currently ongoing legislative procedure, the Swiss National Council and the Council of States approved the bill for the partial revision of the Federal Law on Patents for Inventions, with a referendum deadline of 4 July 2024.
In particular, the bill provides for the Swiss Federal Institute of Intellectual Property (Institut Fédéral de la Propriété Intellectuelle – IPI) to be required to carry out a search of the state of the art for each patent application, and for applicants to be entitled to request an examination of novelty and inventive step in respect of their inventions.
