COUNTERFEITING-SIMPLIFIED PROCEDURE FOR DESTROYING GOODS IN SMALL CONSIGNMENTS
On April 26, 2023, the Swiss Federal Council adopted the draft federal law on “the introduction of a simplified procedure for the destruction of small consignments in intellectual property law”, in order to overcome the complexity of the current procedure for the destruction of counterfeit goods (information both for the intellectual property rights holder, who will be obliged to take several administrative steps, and for purchasers who have ordered the infringing products, etc.).
Under the current legislative revision, the rights holder will have the choice between destruction under the classic procedure, and implementation of the new simplified procedure. The latter involves informing only the person who placed the purchase order for the counterfeit products, which will be destroyed if that person does not object to the destruction.
