EU-LEVEL PROTECTION FOR DESIGNS AND MODELS

As a reminder, on October 10, 2024, the Council of the European Union adopted the Revised Directive on the Legal Protection of Designs and the Amended Regulation on Community Designs (cf. our news here).

Regulation (EU) 2024/2822 and Directive (EU) 2024/2823 of October 23, 2024 were thus published in the Official Journal of the European Union (OJEU) on November 18, 2024.

The Regulation will take effect in two stages, depending on the amendments made: starting either May 1, 2025 or July 1, 2026.

Member States will be required to transpose the Directive within 36 months of its entry into force, no later than December 9, 2027.
