PROTECTION OF DESIGNS AT EUROPEAN UNION LEVEL (‘DESIGNS PACKAGE’)

The objective of the ‘Designs Package’ is to enhance the current system of design protection in order to strengthen, simplify and harmonise it. Indeed, Directive 98/71 of 13 October 1998 on the legal protection of designs and Regulation (EC) No 6/2002 of 12 December 2001 on Community designs needed to be updated and modernised.

It is against this contextual backdrop that the Council of the European Union, on 10 October 2024, adopted the revised directive on the legal protection of designs and the amended regulation on Community designs.

The texts adopted are aimed in particular at improving registration procedures, harmonising European and national systems, and bringing the legislation currently in force in line with the era of digital designs and 3D printing.

The new texts will shortly be published in the Official Journal of the European Union (OJEU).
