THE EUROPEAN UNITARY PATENT SYSTEM CAME INTO FORCE ON JUNE 1, 2023

The European Patent with unitary effect and the Unified Patent Court (UPC) came into force on June 1st, 2023.

The Unitary Patent System currently makes it possible to obtain a single form of protection in the 17 countries of the European Union that have ratified the UPC Agreement, based on the European patent granted by the European Patent Office (EPO).

However, the request for unitary effect must be made within one month from the grant of the European Patent.

At the same time, the procedure for validation of the European Patent by its owner in the designated countries is still effective for countries outside the Unitary Patent System, in particular Switzerland.
